WAUSAU — A new trial date has been set for a 45-year-old man accused of robbing a Schofield Dollar General store at gunpoint, one week after a judge was forced to declare a mistrial in the case.
Phillip Spiller of Schofield faces charges of armed robbery and theft in connection with the Jan. 1, 2017 armed robbery of Dollar General. Police say Spiller entered the Grand Avenue store just before 8 a.m., pulled out a gun and demanded cash from employees.
No one was injured.
On Jan. 18, during the second day of a two-day jury trial, Marathon County Circuit Judge Greg Huber declared a mistrial after a key witness failed to appear.
A final pretrial hearing will be held March 13, with a new two-day trial set to begin April 17.
The case is one of three pending against Spiller in Marathon County Circuit Court. Spiller had been released in March after posting a $25,000 cash bond, but has been back in custody since September. He is currently being held in the Marathon County Jail.
