A 44-year-old Wausau man is facing his sixth charge of operating while intoxicated after a traffic stop last month, court records show.

Timothy J. Mischock is being held on a $10,000 cash bond after an initial appearance Feb. 2 in Marathon County Circuit Court. His most recent prior OWI conviction was in 2015, according to court records. He faces mandatory prison time if he is convicted of the latest charge.

An Everest Metro Police officer pulled Mischock over late the night of Jan. 31 after allegedly spotting him deviating from his lane multiple times on Camp Phillips Road. According to court documents, Mischock continued traveling about 400 feet after the officer activated his emergency lights and siren but eventually came to a stop on Crystal View Drive.

Mischock, who allegedly could not stand straight and was swaying while speaking to police, refused field sobriety tests and was arrested on probable cause, court records show. A preliminary breath test was not conducted.

Chemical testing of Mischock’s blood was performed at Marshfield Medical Center and was sent to the Wisconsin State Crime Lab for analysis. The results are pending.

Mischock was also cited for operating with open intoxicants in the vehicle and unsafe lane deviation, which will be addressed through the Everest Metro Municipal Court.

A preliminary hearing is set for Feb. 21.

You are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.
