MADISON, Wis. – A Winona, Minn. man who used social media to take advantage of an 11-year-old girl two years ago in rural Buffalo County was sentenced to 15 years in prison for enticing a child for sex and first degree sexual assault of a child under 12.

Buffalo County Circuit Judge James Duvall gave 33-year-old Jacob D. Vogel a total 35-year sentence that included 15 years confinement in prison and 20 years of extended supervision after being released from jail.

Vogel was ordered to pay the crime victim $17,892 in restitution.

 

The plea agreement settled the two-year-old case just weeks before it was scheduled for a jury trial. Vogel’s defense attorney was Matthew Krische of Eau Claire.

Investigators said Vogel used social media to exchange sexually explicit images with the girl and persuade her to meet up with him in rural Waumandee.

Vogel drove from Winona to Waumandee in his pickup truck, convinced the girl to go for a ride with him, then pulled over and parked about a mile away where he pressured her to engage in sexual acts.

Authorities said Vogel shot photos and video of the assault, a sex crime that initially led to federal charges of producing child pornography and crossing state lines with intent to have sex with a child. Once the crime became known, authorities said the girl produced detailed evidence of what happened, including images, videos and messages.

Federal agents later searched Vogel’s truck and found the girl’s DNA and eyeglasses. Evidence also was seized from Vogel’s online and wireless accounts as well as records from a GPS tracking device in his pickup.

Vogel was credited for 211 days served.
